Ordinanance 2025-1

The Town of Roosevelt, Burnett County, does ordain as follows:
  1. The provisions of Chapter 125, Wis. Stats., defining and regulating the sale, procurement, dispensing, and transfer of alcohol beverages are adopted and made a part of this Ordinance by reference. A violation of any such provision shall constitute a violation of this Ordinance. 
  2. Abandonment of License issued by the Town in accordance with Ch. 125, Wis. Stats. is a basis upon which the license may be revoked, suspended, or non-renewed as provided in Section 3 below. This Ordinance was adopted pursuant to the power granted to the Town under § 125.10(1), Wis. Stats. For purposes of this Ordinance, “Abandonment of License” means a failure or refusal of the licensee to exercise the privileges granted under the license in question, including the use of the licensed premises, for the purpose for which the license was granted for a period of thirty (30) days or more consecutive days or the failure to open the licensed premises to the public for the purpose for which the license was granted for 50% or more of the days in any 12-month period without prior approval of the Town Board. In addition to general grounds, the loss of the right to make use of the licensed premises for purposes of the license, such as may result from the expiration or revocation of a lease or the sale by the licensee of the licensed premises to a third party, shall constitute Abandonment of License upon the passage of the requisite period of time. 
  3. If disciplinary action is taken against  a licensee, including revocation, suspension, or non-renewal of a license issued under Ch. 125, Wis. Stats., the procedure mandated under present Wisconsin Statute 125.12, or its successor, will be followed.  In the event the licensee cannot be found, any summons under Wis. Stat. Chapter 125 may be published once in a newspaper of general circulation deemed most likely to provide notice to the licensee, or as otherwise required by Wisconsin law. Any license that has been revoked shall not be reinstated within the following 12 months and the licensee may not receive a refund of any license fee.  
  4. In lieu of a hearing, the Town Board may accept surrender of the license, and the board shall then determine the time period before another application for an alcohol beverage license received by the former licensee will be considered by the Town Board. 
  5. SEVERABILITY. In the event any portion of this ordinance is or becomes invalid or illegal, the remaining portions shall remain in full force and effect.
  6. EFFECT. This ordinance shall take effect following passage and posting in three public places by the Clerk.
